ORANGE COUNTY (December 4, 2024) – Today, Assemblymember Diane Dixon (R-Newport Beach) provided the following statement:
“I am delighted with the decision by the US Court of Appeals for the Ninth Circuit. The Court upheld one of the most important tenets of our community: local control.
Specifically, the opinion upheld that the City of Costa Mesa could deny a conditional-use permit for the Ohio House LLC, a facility purporting to offer residential drug and alcohol recovery treatment, in an area not zoned for these services.
The facility, which was attempting to overturn the jury’s verdict on appeal, failed to prove that Costa Mesa’s zoning code is discriminatory.
While we want people to receive the treatment they need to get better, it is imperative that we allow cities to do what is best for their communities. We must ensure patients and residents are in a safe environment where people that need help can get well.”
